By using ExecHero, you agree to these Terms.

These Terms & Conditions govern your access to and use of ExecHero websites, products, services, software, trainings, assessments, applications, communications, events, materials, infrastructure, and related offerings. By accessing, purchasing, subscribing, registering, submitting information, booking an assessment, using a platform, or participating in any ExecHero offering, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use ExecHero products, services, websites, software, trainings, communications, or materials.

These Terms apply across the ExecHero ecosystem.

These Terms apply to all current and future ExecHero offerings, including but not limited to:

• ExecHero™, ExecHeroGO™, ARCS™, Decision Performance Infrastructure™, Decision-Led™ systems, and related infrastructure.
• SDCC™, SDCC Way™, Subconscious-Driven Conscious Closing™, Biological Influence™, Decision Leadership™, and related frameworks.
• Live Call HUD™, Digital ExecHero™, Decision Forge™, Decision Mirror™, ExecHero Dojo™, Fractional Decision Leadership™, and related systems.
• Books, courses, videos, trainings, templates, scripts, frameworks, blueprints, assessments, workbooks, calculators, events, coaching, advisory, and implementation support.
• Communications, SMS, phone, voice, email, AI-assisted responses, automations, workflows, platform access, and support services.

Users are responsible for accurate information and secure access.

You must be at least 18 years old and legally able to enter into agreements to use ExecHero services. By using ExecHero on behalf of a company, organization, team, client, or entity, you represent that you have authority to bind that organization to these Terms.

• You agree to provide accurate account, billing, contact, and business information.
• You are responsible for maintaining the confidentiality of login credentials and account access.
• You are responsible for all activity occurring under your account or authorized users.
• You must promptly notify ExecHero of suspected unauthorized access or security concerns.

Purchases, subscriptions, and payment obligations must be honored.

Fees, pricing, payment terms, subscription terms, installment terms, renewal terms, cancellation terms, and refund policies may vary by product, program, platform, package, offer, contract, or written agreement.

• You agree to pay all fees associated with products, services, software, subscriptions, implementation, advisory, coaching, training, or other offerings you purchase.
• Unless otherwise stated in writing, payments are due according to the terms presented at purchase, checkout, invoice, agreement, or order form.
• Subscriptions may renew automatically unless canceled according to the applicable cancellation process.
• Failed payments, chargebacks, disputed payments, or non-payment may result in suspension, termination, collections, loss of access, or legal recovery efforts.
• Refunds, if any, are governed by the specific written refund policy for the product or service purchased.
• Digital products, trainings, courses, software access, implementation work, coaching, advisory, setup fees, and completed services may be non-refundable unless expressly stated otherwise in writing.

ExecHero intellectual property is proprietary and protected.

All ExecHero materials, systems, frameworks, content, software, methods, prompts, workflows, decision architectures, scripts, trainings, templates, books, assessments, visuals, videos, audio, copy, course materials, calculators, simulations, dashboards, AI systems, and related intellectual property are owned by ExecHero or its licensors and are protected by copyright, trademark, trade secret, contract, and other applicable laws.

No ownership rights are transferred to you by purchasing, accessing, downloading, viewing, using, or participating in any ExecHero product, service, training, software, platform, or material.

ExecHero brand names, marks, and proprietary terms are protected.

The following names, marks, phrases, frameworks, and related brand assets are proprietary to ExecHero and may be protected by trademark, common law trademark, copyright, trade secret, or other rights:

• ExecHero™, The ExecHero™, ExecHeroGO™, ExecHero Dojo™, ARCS™, Live Call HUD™, Digital ExecHero™, Decision Forge™, Decision Mirror™, Fractional Decision Leadership™, and related marks.
• SDCC™, SDCC Way™, Subconscious-Driven Conscious Closing™, Biological Influence™, Decision Leadership™, Decision Performance Infrastructure™, Decision-Led™, Behavioral Decision Intelligence™, and related frameworks.
• Convert Clients™, Warrior Guide™, Dojo™, Sensei™, Close Blades™, Neural Driver Lines™, SAPs™, Conversation Catalyst™, and related training assets.
• Any proprietary scripts, decision maps, training systems, prompts, scoring frameworks, assessments, diagrams, pathways, naming conventions, methodologies, or ecosystem assets.

You may not use ExecHero names, marks, branding, frameworks, logos, or proprietary terms in a manner that suggests ownership, affiliation, endorsement, certification, licensing, partnership, or authorization without express written permission.

You receive limited access, not ownership.

Subject to compliance with these Terms and payment of applicable fees, ExecHero grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the purchased or authorized products, services, training materials, and platforms for your personal or internal business use only.

This license does not permit resale, redistribution, public teaching, public performance, commercial sublicensing, competing use, reverse engineering, derivative product creation, or transfer of ExecHero materials to unauthorized parties.

You may not copy, extract, teach, resell, or replicate the system.

You may not reproduce, reverse engineer, extract, deconstruct, scrape, train competing systems upon, distribute, teach, publish, license, resell, commercialize, copy, modify, or create derivative works from any ExecHero intellectual property without express written permission.

• No unauthorized sharing of login credentials, course access, software access, templates, scripts, recordings, prompts, systems, or materials.
• No use of ExecHero content to train, develop, improve, or operate competing AI systems, coaching programs, sales training, software, or consulting frameworks.
• No recording, downloading, screenshotting, scraping, copying, redistributing, or republishing materials except where expressly allowed.
• No use of ExecHero materials to create substantially similar products, services, courses, AI tools, prompts, simulations, coaching programs, or sales frameworks.
• No removal of copyright, trademark, confidentiality, proprietary, or ownership notices.

ExecHero may use AI-assisted systems, automation, voice, SMS, and digital communications.

Certain ExecHero systems may use artificial intelligence, automation, predictive systems, decision support, message routing, conversation analysis, call summaries, response generation, lead processing, SMS, email, voice, web chat, and other machine-assisted communication technologies.

By submitting forms, booking appointments, using our systems, becoming a client, communicating with ExecHero, or providing contact information, you consent to communications from ExecHero and its systems through phone calls, SMS messages, email, AI-assisted systems, voice technology, automated technologies, and related communication methods.

• Message and data rates may apply.
• Communications may be automated, AI-assisted, human-assisted, or a combination.
• Calls, messages, chats, and interactions may be recorded, transcribed, analyzed, summarized, routed, or stored for business, support, quality, training, compliance, and service purposes.
• You may opt out of SMS where supported by replying STOP.
• Users and clients are responsible for complying with applicable communication, consent, telemarketing, industry, and privacy laws.

ExecHeroGO™ access is governed by platform and service rules.

ExecHeroGO™ may provide access to calendars, forms, messaging, funnels, courses, payments, automations, workflows, CRM-style records, calls, recordings, transcripts, dashboards, training environments, and related business tools.

• You are responsible for the accuracy, legality, consent status, and permission status of data you upload, import, process, or use inside ExecHeroGO™.
• You may not use ExecHeroGO™ for spam, unlawful outreach, deceptive practices, harassment, abusive messaging, unauthorized data processing, or illegal activities.
• Platform availability, features, integrations, and functionality may change, pause, degrade, or be discontinued at any time.
• ExecHero may suspend or terminate access for misuse, non-payment, violation of these Terms, security concerns, legal risk, or platform abuse.

Clients remain responsible for their business, data, compliance, and decisions.

Clients are responsible for their offers, pricing, sales process, team conduct, customer relationships, messaging approvals, imported data, lead lists, compliance obligations, platform usage, industry rules, and implementation decisions.

• You are responsible for obtaining necessary consent for communication with prospects, customers, leads, applicants, clients, or other contacts.
• You are responsible for reviewing AI-assisted outputs, scripts, messages, workflows, recommendations, and communications before relying on them.
• You are responsible for complying with laws applicable to your industry, geography, communications, advertising, employment, healthcare, finance, privacy, and business practices.
• You are responsible for the actions of your employees, contractors, users, team members, representatives, and authorized platform users.

ExecHero does not guarantee income, revenue, conversion, or business results.

ExecHero provides education, software, infrastructure, tools, training, implementation support, decision support, and advisory services. No representation or guarantee is made regarding revenue, income, profitability, close rates, booked calls, lead generation, return on investment, business growth, leadership results, hiring outcomes, sales performance, personal performance, or any other outcome.

Results vary significantly based on numerous factors, including execution, market conditions, offer quality, pricing, lead quality, sales skill, team behavior, compliance, follow-up, leadership, communication, capital, industry conditions, timing, and circumstances beyond ExecHero’s control.

Testimonials and examples are not guarantees.

Testimonials, case studies, examples, client stories, revenue claims, close-rate improvements, business outcomes, screenshots, and performance examples represent individual experiences and are not intended to represent, promise, or guarantee that current or future users will achieve similar results.

Some results may be exceptional and not typical. Individual outcomes depend on effort, execution, experience, market, offer, audience, timing, and other variables. Past performance does not guarantee future results.

ExecHero supports decisions. It does not make decisions for you.

ExecHero systems provide decision support, decision intelligence, education, training, frameworks, analysis, guidance, communication support, and infrastructure. ExecHero does not make decisions on behalf of users, clients, companies, leaders, employees, prospects, customers, patients, candidates, or any other party.

Users remain solely responsible for all decisions, actions, communications, financial commitments, business operations, hiring decisions, legal matters, healthcare decisions, employment decisions, sales activity, leadership decisions, and outcomes resulting from use of ExecHero products or services.

Access may be suspended for misuse or harmful conduct.

You agree not to misuse ExecHero websites, platforms, communications, software, trainings, communities, events, support channels, or materials. Prohibited conduct includes harassment, abuse, unlawful activity, unauthorized access, platform interference, fraud, spam, intellectual property misuse, deceptive conduct, or behavior that harms ExecHero, users, clients, partners, systems, or reputation.

ExecHero may suspend or terminate access to any product, service, platform, group, event, community, training, or software environment at its discretion for violation of these Terms, non-payment, misconduct, risk, security concerns, or business reasons.

Some functionality may rely on third-party technology providers.

ExecHero may use third-party platforms, processors, hosting providers, AI providers, communication providers, payment processors, analytics services, calendar systems, integration tools, email platforms, SMS providers, voice providers, and other technology services to deliver the ecosystem.

ExecHero is not responsible for third-party outages, interruptions, terms, policies, errors, data handling, limitations, pricing changes, integration failures, or discontinued features. Your use of third-party services may be subject to separate terms and policies.

ExecHero may suspend or terminate access where necessary.

ExecHero may suspend, restrict, or terminate access to any website, product, service, platform, training, community, or material for violation of these Terms, non-payment, suspected fraud, abusive conduct, security risk, legal risk, unauthorized use, intellectual property misuse, or other business reasons.

Termination does not relieve you of payment obligations, confidentiality obligations, intellectual property restrictions, indemnity obligations, or other provisions intended to survive termination.

Liability is limited to the maximum extent permitted by law.

To the maximum extent permitted by law, ExecHero and its owners, officers, employees, contractors, affiliates, agents, service providers, licensors, and representatives shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or similar damages, including lost profits, lost revenue, lost data, lost opportunities, business interruption, reputational harm, or decision-related losses.

To the maximum extent permitted by law, ExecHero’s total liability for any claim arising out of or relating to the use of our products, services, software, platforms, materials, communications, or these Terms shall not exceed the amount paid by you to ExecHero for the specific product or service giving rise to the claim during the three months preceding the claim, or one hundred dollars if no amount was paid.

You agree to protect ExecHero from claims caused by your use or misuse.

You agree to indemnify, defend, and hold harmless ExecHero and its owners, officers, employees, contractors, affiliates, agents, service providers, licensors, and representatives from any claims, damages, liabilities, losses, costs, expenses, and fees arising from your use of ExecHero products or services, violation of these Terms, misuse of intellectual property, unlawful communications, data misuse, client activity, imported data, team conduct, or violation of applicable law.

These Terms are governed by applicable law.

Unless otherwise stated in a separate written agreement, these Terms shall be governed by the laws of the state or jurisdiction in which ExecHero primarily operates, without regard to conflict of law principles. Any disputes shall be handled in the appropriate courts or forums located in that jurisdiction unless otherwise required by law or agreed in writing.

ExecHero may update these Terms periodically.

ExecHero may update these Terms from time to time to reflect changes in our services, systems, laws, business practices, platform operations, or risk requirements. Updated Terms will be posted with a revised effective date. Continued use of ExecHero products, services, websites, or platforms after updates means you accept the revised Terms.
